Universal Terms of Service

1. Your Relationship With Us

Welcome to Braai (the “Platform”), which is operated by Braai (Pty) LTD under license from BuzzGrowth (Pty) LTD. The Platform architecture and underlying intellectual property are owned and developed by BuzzGrowth (Pty) LTD (collectively “Braai”, “we”, or “us”).

These Terms of Service (the “Terms”) govern your access to and use of the Braai application, website, and services (collectively, the “Services”). Our Services are provided for private, non-commercial use, unless you operate a verified Merchant or Business account.

2. Accepting the Terms

By accessing our Services, you confirm that you accept these Terms. If you do not agree, you must not use the Services. Your use is also governed by our Privacy Policy, Community Guidelines, and Child Safety Policy.

Minors: If you are under the age of 18, you may only use the Services with the explicit consent and supervision of your parent or legal guardian. We employ mandatory Age Assurance protocols to protect the younger members of our community.

3. Your Account & Conduct

You must provide accurate information when creating your account. You are responsible for maintaining the confidentiality of your credentials. You agree not to:

• Impersonate others or create deceptive identities.
• Engage in harassment, bullying, or the promotion of hate speech.
• Bypass our Safe-by-Design architectural controls (e.g., attempting to access adult circles as a minor).
• Extract data or use automated systems (bots) to scrape the Platform.

4. Intellectual Property & User Content

A. Braai Content

The "look and feel," software, graphics, and proprietary "Infinity Polish" animations are the exclusive property of BuzzGrowth (Pty) LTD. You may not reproduce or exploit this content without prior written consent.

B. User-Generated Content (UGC)

You retain ownership of the copyright in content you post. However, by submitting content, you grant Braai an unconditional, irrevocable, non-exclusive, royalty-free, worldwide license to host, reproduce, and distribute your content within the Platform.

Through-to-the-Audience: This license is provided on a "through-to-the-audience" basis, ensuring we can provide the Services to our global community without incurring royalty obligations to third parties.

5. Marketplace & Virtual Items

The Braai Marketplace facilitates peer-to-peer trading. Braai is a facilitator and is not a party to the actual transaction between buyer and seller.

• Warmth-Based Escrow: Payments are held securely until the gathering/handover is confirmed.
• BraaiCoins: Virtual items and currencies purchased on the Platform are non-refundable and have no real-world monetary value outside the Services.

6. Liability & Disclaimers

THE SERVICES ARE PROVIDED “AS IS.” While we proactively mitigate foreseeable harm through our Flame Filter AI and human moderation, we cannot guarantee the complete absence of inappropriate content.

To the maximum extent permitted by law, Braai (Pty) LTD shall not be liable for any indirect or consequential damages arising from your use of the Platform.

7. South African Specific Terms

As a South African company, we comply with:

• Consumer Protection Act (CPA): Your statutory rights remain unaffected.
• ECT Act: This agreement constitutes a valid electronic contract.
• Governing Law: These Terms are governed by the laws of the Republic of South Africa.

8. Termination

We reserve the right to suspend or terminate your access if you violate these Terms or our Community Guidelines. You may terminate this agreement at any time by deleting your account, which will trigger our Total Wipe data deletion protocol.
